Responsabilidad por efectos adversos de las vacunas contra la COVID-19
Abstract
Cuando una vacuna produce un efecto adverso no deseado en el paciente, este tiene derecho a reclamar una indemnización por daños y perjuicios debiendo la responsabilidad recaer en el productor o, en su caso, en la Administración con competencias para autorizar y vigilar los medicamentos y productos sanitarios, de concurrir las concretas circunstancias necesarias para ello, citamos al respecto la reciente Sentencia del Tribunal Supremo, Sala Tercera de lo Contencioso Administrativo, Sección 5ª, Sentencia 1806/2020 de 21 de diciembre 2020.
Aunque en el caso de una situación tan excepcional como la pandemia por la COVID-19 los términos deben cambiar.
