El reto de la argumentación jurídica para los profesionales del derecho
Abstract
La argumentación jurídica es una de las tareas más importantes del profesional
jurídico. En la defensa del cliente todo abogado debe persuadir y convencer al tribunal
de la veracidad de su pretensión. La argumentación jurídica es el medio a través del cual
el abogado intenta conseguir esto, utilizando argumentos sólidos en derecho y a su vez
persuasivos. Sin embargo, la falta de ética prima en esta práctica, olvidando el fin de
búsqueda de la justicia del abogado y sustituyéndolo por la búsqueda del interés propio
y la mentira a la hora de argumentar. Legal Reasoning is one of the most important Legal Professional’s tasks. During the
customer advocacy every lawyer must persuade and convince the court of the
truthfulness of its claim. Legal Reasoning is the mean through which the lawyer tries to
get this, using strong legal arguments and at the same time persuasive. However, lack of
ethics has a priority place in this practice, forgetting lawyer’s aim of pursuit of justice
and replacing it with the pursuit of self-interest and the lie during the reasoning.
