"¿Pueden los animales ser considerados sujetos de Derecho? Reflexiones desde la Filosofía del Derecho española en el siglo XXI."

Abstract

La posibilidad de que los animales no humanos puedan ser sujetos de derechos ha llevado a numerosos autores a posicionarse al respecto. En este trabajo se pretende realizar un estudio sistemático acerca de la posibilidad de aceptar esta titularidad a través del análisis de los diferentes conceptos y características que conceden tal condición. Se hará una exposición de las opiniones de los pensadores más influyentes que han reflexionado sobre este asunto y las diferentes corrientes filosóficas en las que se fundamentan para, finalmente, presentar el régimen jurídico al que están sujetos los animales y poder emitir una opinión fundada.

The possibility that non-human animals can be subjects of rights has led numerous authors to take a position on the matter. The aim of this paper is to carry out a systematic study on the possibility of accepting this ownership through the analysis of the different concepts and characteristics that grant such status. The opinions of the most influential thinkers who have reflected on this issue and the different philosophical currents on which they are based will be presented in order to finally present the legal regime to which animals are subject and to be able to issue a well-founded opinion.
