El tratamiento procesal de las víctimas de delitos contra la libertad sexual e indemnidad sexual

Abstract

la víctima es uno de los elementos fundamentales del proceso penal, siendo aquella la que sufre un menoscabo patrimonial, corporal o moral constitutivo de delito, por un agresor que atenta contra un bien jurídico protegido. Podemos afirmar que es una figura inherente al proceso, si bien en la actualidad ha quedado relegada a un segundo plano. Este trabajo pretende enfocar su atención en la víctima y las necesarias garantías jurídicas que esta debería tener en el proceso penal de delitos contra la libertad sexual, con especial hincapié en el fenómeno de la “revictimización” y las medidas para evitarlo.

the victim is one of the most fundamental elements of the prosecution process, given that they are the ones who suffer a pecuniary, physical or mental damage that constitutes a crime, by an aggressor who infringes upon society´s protected values. We can state that the victim is an inherent figure in the process, although currently it has been relegated to a secondary role. This paper aims to focus on the victim and the necessary legal guarantees that they should have in the criminal process for sexual offenses, with special emphasis on the phenomenon of "revictimization" and the measures to prevent it.
