El contenido esencial del derecho a la vida e integridad personal como límite a las investigaciones biomédicas

Abstract

El avance de las investigaciones en biomedicina y los constantes descubrimientos en dicho ámbito, plantean problemáticas concretas ante las cuales es necesario responder con figuras jurídicas nuevas que traten, por lo menos, de paliar las consecuencias que estos avances traen para la existencia social del ser humano. Es decir, la libertad de investigación biomédica implica, por un lado, mejoras, pero por otro, implica también cierto tipo de afectaciones para los derechos humanos, especialmente para el derecho a la vida y el derecho a la integridad personal, ambos inherentes a la dignidad humana y por ello ha de ser limitado. Aquellas aplicaciones biomédicas que resulten desproporcionadas o cuyos resultados sean menores que los riesgos o daños que producen habrán de ser rechazadas.

The advance of research in biomedicine and the constant discoveries in this field, raises specific problems to which it is necessary to answer with new legal figures that attempt, at least, to alleviate the consequences that this progress brings for the social existence of all human beings. That is to say, while freedom of biomedical research implies improvements, it also implies certain types of effects on human rights, especially for the right to life and the right to personal integrity, both inherent to human dignity and therefore must be limited. Those biomedical applications that result to be disproportionate or whose results are less important than the risks or damages they produce must be rejected.
