Análisis de los sucesos ocurridos en la construcción y venta de inmueble

Abstract

En presente Trabajo de Fin de Máster del Máster Universitario en Derecho de la Empresa, se resuelve el caso práctico propuesto. Dicho informe ofrece una introducción y conclusiones principales, un análisis de la consulta y el alcance del asesoramiento, antecedentes relevantes y la legislación española y comunitaria aplicable y que se encontraba vigente en el momento de elaboración del informe. Tras estos apartados, se evalúan las responsabilidades de agentes intervinientes en una obra, desde el promotor hasta el Organismo de Control Técnico, en el caso de que un trabajador de la obra produzca un daño a un tercero ajeno a ésta. Igualmente, se analizará también la responsabilidad de los agentes intervinientes en una obra cuando se produzca un accidente de trabajo debido a una infracción de medidas de seguridad. Además, el informe analiza la cobertura de una póliza decenal respecto a diferentes vicios y defectos que presentan las viviendas tras su adquisición. Por último, el informe evalúa la posible actuación de una entidad de capital riesgo como intermediador de crédito inmobiliario, así como las condiciones y garantías que debería presentar esta operación.

In this Master's Thesis of the Master's in Business Law, the proposed case study is solved. This report offers an introduction and main conclusions, an analysis of the consultation and the scope of the advice, relevant background and the applicable Spanish and EU legislation that was in force at the time of preparation of the report. After these sections, the responsibilities of the agents involved in a construction site are evaluated, from the promoter to the Technical Control Body, in the event that a worker on the site causes damage to a third party. Likewise, it will also analyze the liability of the agents involved in a construction site when a work accident occurs due to a breach of safety measures. In addition, the report analyzes the coverage of a ten-year policy with respect to different vices and defects that homes present after their acquisition. Finally, the report evaluates the possible involvement of a private equity firm as a real estate credit intermediary, as well as the conditions and guarantees that this operation should present.
