Interpretación judicial en tiempos de IA: el caso del Online Sytem o Smart Courts en materia de derechos fundamentales

Abstract

Esta investigación analiza el potencial transformador de la Inteligencia Artificial en el ámbito de la interpretación judicial en la era digital. Se examinan los desafíos y consecuencias de los sesgos algorítmicos en los Smart Courts respecto a los Derechos Fundamentales. El trabajo se estructura en varios capítulos fundamentales. En primer lugar, se explora el concepto de la IA y su impacto en el ámbito legal, detallando beneficios y resultados obtenidos. Posteriormente, se adentra en el análisis de los Smart Courts y Online Courts, abordando su concepción, hitos relevantes y el panorama actual de estos sistemas. Una parte crucial se enfoca en los derechos fundamentales, examinando su definición, protección jurisdiccional y límites, con especial énfasis en el derecho a la intimidad, a la igualdad y no discriminación y a la tutela judicial efectiva. Se analizan también los sesgos en la IA y su repercusión jurisprudencial en este contexto. Finalmente, se abordan los desafíos éticos y legales que surgen de la implementación de la IA en el ámbito judicial. Con este trabajo se pretende ofrecer una perspectiva completa sobre la intersección entre la IA y la interpretación judicial en el marco de los derechos fundamentales, destacando los desafíos, implicaciones éticas y potenciales direcciones futuras para una implementación más efectiva y responsable de la IA en este ámbito.

This research analyses the transformative potential of Artificial Intelligence in the field of judicial interpretation in the digital age. It examines the challenges and consequences of algorithmic biases in Smart Courts concerning Fundamental Rights. The paper is structured in several key chapters. First, it explores the concept of AI and its impact on the legal sphere, detailing the benefits and results obtained. Subsequently, it delves into the analysis of Smart Courts and Online Courts, addressing their conception, relevant milestones, and the current landscape of these systems. A crucial part focuses on fundamental rights, examining their definition, jurisdictional protection, and limits, with special emphasis on the right to privacy, to equality and non-discrimination, and to effective judicial protection. Biases in AI and their jurisprudential impact in this context are also analyzed. Finally, the ethical and legal challenges arising from the implementation of AI in the judicial sphere are addressed. This paper aims to provide a comprehensive perspective on the intersection between AI and judicial interpretation in the fundamental rights framework, highlighting the challenges, ethical implications, and potential future directions for more effective and responsible implementation of AI in this field.
