Estado de derecho en la Unión Europea, especial referencia a la (des)protección de los derechos LGTBI en Polonia y Hungría

Abstract

Todo parece indicar que, durante los últimos quince años, en Hungría y Polonia se han registrado graves retrocesos en materia de los derechos humanos del colectivo LGBTI. Sirviéndose de una metodología de investigación basada en el análisis crítico sostenido sobre la revisión de la pertinente literatura, el presente trabajo persigue examinar esta situación y, en particular, la (in)eficacia de los mecanismos de tutela judicial de la Unión Europea para revertir dicha situación. Y concluye reconociendo los avances, pero también la necesidad de mejorar la aplicación de los referidos mecanismos en aras de la protección efectiva del Estado de Derecho y de los derechos de las personas LGTBI, en los dos Estados miembros en cuestión y en el conjunto de la Unión Europea.

Everything seems to indicate that, during over the last fifteen years, serious setbacks have been recorded in Hungary and Poland in terms of the human rights of the LGBTI community. Using a research methodology based on critical analysis sustained on the review of the relevant literature, this work seeks to examine this situation and, in particular, the (in)effectiveness of the judicial protection mechanisms of the European Union to reverse said situation. And it concludes by recognizing the progress, but also the need to improve the application of the aforementioned mechanisms for the effective protection of the rule of law and the rights of LGTBI people, in the two Member States in question and in the whole of the European Union.
