La teoría de los derechos de la naturaleza está en auge. Y no solamente ha recibido la atención
del ámbito académico, sino que este paradigma revolucionario ha logrado trascender lo
meramente teórico, revelando así la obsolescencia de los límites legales actuales. Desde el
reconocimiento de los derechos de la naturaleza en la nueva Constitución de Ecuador de 2008,
pasando por la Ley de Derechos de la Madre Tierra de 2010 en Bolivia, hasta las resoluciones
sobre la «Armonía con la Naturaleza» de la Asamblea General de las Naciones Unidas,
pareciera que el atractivo de esta teoría ha puesto en jaque al antropocentrismo que tanto
caracteriza a la tradición jurídica occidental. En este escenario jurídico emergente, una masa
de agua específica ha recibido la principal atención: los ríos. Así, en el presente trabajo nos
centraremos en tres casos: el río Vilcabamba (Ecuador) y los ríos Atrato (Colombia) y
Whanganui (Nueva Zelanda) The theory of the rights of nature is on the rise. And it has not only garnered attention from the academic sphere, but this revolutionary paradigm has also managed to transcend the purely theoretical, thus revealing the obsolescence of current legal boundaries. From the recognition of the rights of nature in the new Constitution of Ecuador in 2008, through the Law of the Rights of Mother Earth in Bolivia in 2010, to the resolutions on "Harmony with Nature" of the United Nations General Assembly, it seems that the appeal of this theory has challenged the anthropocentrism that characterizes Western legal tradition. In this emerging legal landscape, a specific body of water has received the primary focus: rivers. Thus, in this present work, we will focus on three cases: the Vilcabamba River (Ecuador) and the Atrato River (Colombia) and Whanganui River (New Zealand).
