El derecho a la propia imagen ante el desarrollo de la inteligencia artificial

Abstract

Este Trabajo de Fin de Grado aborda el estudio del impacto de la Inteligencia Artificial en el derecho a la propia imagen, en consonancia con el marco constitucional y legal español. Se parte del análisis del artículo 18.1 de la Constitución Española y la Ley Orgánica 1/1982, de 5 de mayo, que garantizan la protección de este derecho fundamental, y se exploran casos concretos que ilustran su aplicación y posibles vulneraciones. Se destaca la autonomía e independencia del derecho a la propia imagen, así como su amplitud, que abarca no solo la representación visual, sino también aspectos como la voz. Esta concepción se vuelve crucial en la era digital, donde la Inteligencia Artificial puede manipular tanto imágenes visuales como vocales de forma convincente, y donde debe existir a la vez un equilibrio entre los derechos individuales y el interés público. Además, se señala el fortalecimiento de la protección de la imagen personal en el contexto de la IA, gracias al nuevo Reglamento del Parlamento Europeo y del Consejo, así como a propuestas de leyes adicionales a nivel nacional y autonómico. Finalmente, se responde a la pregunta planteada sobre cómo la IA puede influir en el derecho a la propia imagen, destacando la posibilidad de intromisiones ilegítimas y la importancia de considerar el contexto y las excepciones legales pertinentes.

This Final Degree Project studies the impact of Artificial Intelligence on the right to one's own image, in accordance with the Spanish constitutional and legal framework. It is based on the analysis of Article 18.1 of the Spanish Constitution and Organic Law 1/1982, of 5 May, which guarantee the protection of this fundamental right, and explores specific cases that illustrate its application and possible violations. The autonomy and independence of the right to one's own image is highlighted, as well as its breadth, which covers not only visual representation, but also aspects such as the voice. This conception becomes crucial in the digital age, where Artificial Intelligence can manipulate both visual and vocal images convincingly, and where there must be a balance between individual rights and the public interest. Furthermore, it points to the strengthening of the protection of personal image in the context of AI, thanks to the new Regulation of the European Parliament and of the Council, as well as proposals for additional laws at national and regional level. Finally, it answers the question raised on how AI may influence the right to one's own image, highlighting the possibility of unlawful intrusions and the importance of considering the relevant context and legal exceptions.
