Existen una serie de derechos y garantías específicos de la justicia juvenil, cuyo fundamento viene asentado por diversos instrumentos internacionales y rigen de manera generalizada. Entre dichos derechos, el derecho del menor de edad a ser oído durante el procedimiento resulta especialmente relevante. Dicho derecho, para cumplirse de forma adecuada, no implica únicamente que el menor disponga de un momento para hablar al final del juicio, sino que requiere que la justicia se adapte a sus necesidades en aras de que comprenda la totalidad del procedimiento y se forme una opinión que poder compartir llegado el momento. Así, la especialización de los diversos operadores jurídicos en contacto con menores, resulta primordial para garantizar que el menor disponga de la posibilidad de ser escuchado. El presente artículo pretende revisar los instrumentos de carácter global y europeo que sientan las bases del derecho a ser oído y la especialización de los profesionales que trabajan en la justicia juvenil, de cara a comprobar si estas cuestiones están debidamente traspuestas al sistema español. Youth justice presents a series of specific rights and guarantees, which find their basis in
several international instruments. Those rights and guarantees are followed all over the
world. Among these rights, the child’s right to be heard during the proceedings is
particularly relevant. In order to fulfill that specific right, the child shall not only be given a
moment to speak at the end of the trial, but also the whole justice system needs to adapt
itself in order to let the young offender understand the proceedings and form his or her
own opinion (that shall be shared when given the moment within the trial). Thus, the
specialization of the various legal practitioners in contact with young offenders is essential
in order to ensure that the minor has the possibility of being effectively heard. The present
article aims to analyze the international instruments (both global and European) that provide the basis of both the right to be heard and the specialization of professionals
working in youth justice. After that, the aim is to check whether these issues are properly
transposed into the Spanish youth justice system.
