dc.description.abstract | Se analiza uno de los principios esenciales del Derecho de la UE, el principio de primacía, desde una perspectiva interdisciplinar y crítica, analizando cómo este principio, llevado hasta sus últimos extremos, podría convertirse en un mecanismo para incumplir las obligaciones internacionales asumidas previamente por los Estados miembros, lo que definimos como “efecto lavadora”. Se parte del análisis desde la perspectiva del Derecho constitucional, el Derecho internacional público, el Derecho administrativo, para llegar propiamente al Derecho Internacional Privado (DIPr) donde apuntamos las dificultades que podría tener legislar en DIPr europeo usando la técnica de las directivas de mínimos. | es-ES |
dc.description.abstract | One of the essential principles of EU Law, the principle of primacy, is analyzed from an interdisciplinary and critical perspective, analyzing how this principle, taken to its extremes, could become a mechanism to breach the international obligations previously assumed by the Member States, what we define as the “washing machine effect”. We start from the analysis from the perspective of constitutional law, public international law, administrative law, to arrive at Private International Law (DIPr) where we point out the difficulties that legislating in European DIPr could have using the technique of minimum directives. | en-GB |
