La autonomía presupuestaria de las Cortes Generales

Abstract

La Constitución española de 1978 reconoce expresamente la autonomía presupuestaria del Congreso de los Diputados y del Senado en su artículo 72. La presupuestaria es la menos visible y quizá la más significativa de las manifestaciones de la autonomía de las Cámaras y en España es amplia y se proyecta a la totalidad del ciclo presupuestario y su control, que es el que las Cámaras deciden que sus cuentas deben tener.

Sus orígenes se remontan al medievo y su fundamento jurídico es constitucional y está hoy ligado al concepto de soberanía y al principio de separación de poderes, por lo que se diferencia de la autonomía financiera que, con otro fundamento y en distintos grados, la ley reconoce a algunos órganos constitucionales.

Además de en la Constitución, esta autonomía se recoge en los Reglamentos de cada Cámara y en sus normas internas de desarrollo. Las leyes en materia presupuestaria, contractual, de subvenciones y patrimonial del Estado, también prevén la autonomía presupuestaria de las Cortes Generales. En los 40 años de vida de nuestra Constitución, el Congreso de los Diputados y el Senado han ejercido con mesura y responsabilidad su deber constitucional en esta materia y han evolucionado en su interpretación conforme a los principios de transparencia y buen gobierno de los caudales públicos.

The Spanish Constitution of 1978 expressly acknowledges the budgetary autonomy of the Congress of Deputies and the Senate in its article 72.The budgetary one is the least visible and perhaps the most significant of the manifestations of the autonomy of the Chambers and in Spain is broad and is projected to the entire budget cycle and its control, which is what the Chambers decide that their accounts must have.Its origins date back to the Middle Ages and its legal basis is constitutional and is nowadays linked to the concept of sovereignty and the principle of separation of powers, so it clearly differs from the true scope of financial au-tonomy that law accords to other constitutional bodies in different degrees.In addition to the Constitution, this autonomy is gathered in the Regula-tions of each Chamber and in other internal rules. The laws on budgetary, contractual, grants and asset matters of the State, also gather the budgetary autonomy of the Cortes Generales.In the 40 years of life of our Constitution, the Congress of Deputies and the Senate have exercised with moderation and responsibility their constitutio-nal duty in this matter and have evolved in its interpretation in accordance with the principles of transparency and good governance of public funds.
