Regadíos históricos como infraestructuras verdes y azules: Análisis sobre la sostenibilidad del patrimonio hidráulico

Abstract

La Comunicación de la Comisión titulada infraestructura verde: mejora del capital natural de Europa publicada en 2013 fue un primer punto de partida que acercaba este concepto a nuestro ordenamiento jurídico y al del resto de estados miembros de la Unión Europea. En 2015 se reformó la Ley 42/2007 de Patrimonio Natural y de la Biodiversidad para introducir la Estrategia estatal de infraestructura verde, y de la conectividad y restauración ecológicas. Esta estrategia fue finalmente publicada a través de la Orden PCM/735/2021 el 9 de julio de 2021. Desde esa fecha tal y como establece el artículo 15 de la Ley 42/2007, las Comunidades Autónomas tienen un plazo máximo de tres años para desarrollar sus propias estrategias que deben al menos contener los objetivos contenidos en la estrategia estatal. En este mismo contexto temporal son varias las voces que reclaman una mayor protección y cuidado del patrimonio hidráulico y de los regadíos históricos no solo por su valor cultural y etnográfico sino también por sus características propias cercanas a la sostenibilidad

En el presente trabajo se analiza usando como caso la región de Murcia si la calificación como infraestructura verde de los sistemas de regadío tradicionales podría ser una opción para por un lado brindar de protección estos entornos y paisajes culturales tan importantes y por otro explotar los beneficios que estas infraestructuras poseen para el desarrollo sostenible

The Commission Communication entitled "Green Infrastructure: Enhancing Europe's Natural Capital" published in 2013 was an initial starting point that brought this concept closer to our legal framework and that of the other Member States of the European Union. In 2015, Law 42/2007 on Natural Heritage and Biodiversity was reformed to introduce the State Strategy for Green Infrastructure, Connectivity, and Ecological Restoration. This strategy was finally published through Order PCM/735/2021 on July 9, 2021. Since that date, as established by Article 15 of Law 42/2007, the Autonomous Communities have a maximum period of three years to develop their own strategies, which must at least contain the objectives contained in the state strategy. In this same temporal context, there are several voices calling for greater protection and care for hydraulic heritage and historical irrigation systems, not only for their cultural and ethnographic value but also for their characteristics close to sustainability.

In this study, using the region of Murcia as a case, the qualification of traditional irrigation systems as green infrastructure is analyzed to explore the possibility of providing protection for these important cultural environments and landscapes while also exploiting the benefits that these infrastructures offer for sustainable development.
