La atenuante analógica en relación con la eximente incompleta de obrar en cumplimiento de un deber, a propósito del empleo de la fuerza por la policía: Comentario a la STS 608/2019
Abstract
En este comentario se analiza la Sentencia núm.
608/2019, de la Sala 2ª del Tribunal Supremo, en la que
se aplicó la circunstancia atenuante analógica, ligada a
la eximente incompleta de obrar en cumplimiento de
un deber, a un agente de la Ertzaintza que durante
una manifestación propinó cuatro golpes en la cabeza
con su porra a una mujer. Se atiende al voto
particular, que discrepa del parecer de la mayoría, y
defiende que no concurre necesidad de uso de la
fuerza en abstracto y que, por tanto, no cabe la
atenuación, y se toma partido a favor de este último. This comment analyzes the Judgement number
608/2019, of the 2nd Chamber of the Supreme Court,
that applied the analogic mitigating circumstance,
linked to the incomplete exemption from acting in
compliance with a duty, to an Ertzaintza agent who
during a manifestation struck a woman in the head
with his baton four times. We study the particular
vote, which says that there is no concurrence of need
to use the force in abstract and, therefore, there is no
reason for mitigate the punishment, and we take side
in favor of the latter.
