La figura del mediador : comparativa entre el sistema español y el estadounidense

Abstract

El objeto de este trabajo es analizar la figura del mediador tanto en el sistema español como en el americano con el fin de lograr descubrir por qué este profesional ha evolucionado progresivamente y se encuentra más valorado en Estados Unidos que en España. Para su elaboración se han examinado la evolución, los objetivos, la formación, el registro, el seguro y los tipos de mediadores en ambos países. De este modo se han comprobado cuáles son las diferencias y semejanzas que comparten estos dos sistemas, así como cuáles podrían ser las posibles sugerencias de implementación por parte de la regulación española con respecto al mediador estadounidense.

The aim of this study is to analyze the mediator´s figure in the Spanish and the American legal systems, trying to achieve not only why this professional has evolved gradually, but also why it is more recognized in the United States than in Spain. In the preparation of this work several aspects of both countries have been examined such as the evolution, the objectives, the training, the register, the insurance and the various types of mediators. Thus, we have been able to verify the differences and similarities between these two systems, as well as the possible suggestions regarding the mediator´s figure that Spain could implement from the American mediator.
