ANALISIS DE LA DOBLE VENTA Y VENTA DE COSA AJENA

Abstract

El presente Trabajo de Fin de Grado analiza las figuras jurídicas de la doble venta y la venta de cosa ajena dentro del marco del Derecho Civil español. Partiendo del estudio del contrato de compraventa y del sistema de transmisión de la propiedad basado en el principio de título y modo, se examinan los elementos que permiten la existencia de ventas múltiples sobre un mismo bien. En particular, se aborda el artículo 1473 del Código Civil, que establece los criterios de preferencia entre compradores en caso de doble venta, valorando su aplicación, sus presupuestos subjetivos y objetivos, así como su evolución doctrinal y jurisprudencial. El trabajo también estudia la figura de la venta de cosa ajena, entendida como aquella en la que el vendedor no es titular del bien en el momento de celebrar el contrato.

This Final Degree Project analyzes the legal concepts of double sale and the sale of another's property within the framework of Spanish Civil Law. Starting from the study of the contract of sale and the system of property transfer based on the principle of title and mode, it examines the elements that allow for multiple sales of the same asset. In particular, it addresses Article 1473 of the Civil Code, which establishes the criteria of preference between purchasers in cases of double sale, assessing its application, subjective and objective requirements, as well as its doctrinal and jurisprudential evolution. The study also explores the figure of the sale of another's property, understood as a situation in which the seller is not the owner of the asset at the time the contract is concluded.
