Los menores en el proceso sucesorio

Abstract

El presente trabajo analiza la capacidad del menor en el ámbito sucesorio, abordando su aptitud para suceder, aceptar o repudiar una herencia, solicitar la partición de la herencia y otorgar testamento. A través de un estudio doctrinal y jurisprudencial, se examinan las limitaciones y facultades que el ordenamiento jurídico español reconoce a los menores en esta materia, así como el papel de sus representantes legales. Asimismo, se exploran los mecanismos de protección establecidos para salvaguardar los intereses del menor en el proceso sucesorio. Finalmente, el trabajo concluye con una reflexión crítica sobre la adecuación de la normativa vigente.

This paper analyzes the legal capacity of minors in the field of succession, addressing their ability to inherit, accept or renounce an inheritance, request the partition of the estate, and make a will. Through a doctrinal and case law study, the limitations and rights granted to minors under Spanish law in this matter are examined, as well as the role of their legal representatives. Furthermore, the protective mechanisms established to safeguard the minor’s interests in the succession process are explored. Finally, the paper concludes with a critical reflection on the adequacy of the current regulation.
