Cohesión real entre los ODS 10 y 16 y el acceso a la justicia de personas con discapacidad en Derecho, Justicia y Sostenibilidad Social

Abstract

Los diecisiete ODS buscan una clara interconexión entre ellos que precisamente recalcan una accesibilidad de carácter universal. En este capítulo serán objeto de análisis dos de estos objetivos en su relación con las personas con discapacidad como grupo vulnerable. El propósito no es otro que reafirmar, por un lado, la necesidad de cumplir con el principio de igualdad de todos los ciudadanos en su acceso a la justicia y, por otro, el deber de garantizar la tutela judicial efectiva recogida en el artículo 24 de la Constitución Española e incluida también en el artículo 13 de la Convención de Nueva York como se verá en párrafos posteriores. Los Estados deben atender a una labor inclusiva y universal en la aplicación de la justicia como valor fundamental, sin excluir a nadie y garantizando así los derechos que todas las personas tienen reconocidos. Para ello, la materialización de los ODS implica la eliminación no sólo de barreras físicas sino tecnológicas, permitiendo a las personas con discapacidad establecer una comunicación fácil y comprensible con los operadores jurídicos en el marco de un proceso judicial.

The seventeen SDGs seek a clear interconnection between them that emphasises universal accessibility. In this chapter, two of these goals will be analysed in relation to persons with disabilities as a vulnerable group. The purpose is none other than to reaffirm, on the one hand, the need to comply with the principle of equality of all citizens in their access to justice and, on the other, the duty to guarantee effective judicial protection set out in article 24 of the Spanish Constitution and also included in article 13 of the New York Convention, as will be seen in subsequent paragraphs. States must work towards an inclusive and universal application of justice as a fundamental value, without excluding anyone and thus guaranteeing the rights to which all persons are entitled. To this end, the materialisation of the SDGs implies the elimination not only of physical barriers but also of technological barriers, allowing persons with disabilities to establish easy and understandable communication with legal operators in the framework of a judicial process.
