Abstract

This chapter examines the exclusion of the bonum coniugum (the good of the spouses) as a ground for matrimonial nullity under canon law, with particular attention to cases of implicit simulation and their treatment in the jurisprudence of the Roman Rota. Recognizing the good of the spouses as an essential element of marriage, the study explores various forms of exclusion, including the rejection of equality and dignity between spouses, the sexual objectification of the other spouse, the exclusion of mutual support, and the refusal to establish a genuine community of life and love. The chapter examines the distinction between explicit and implicit simulation, emphasizing that the latter also requires a positive act of will contrary to an essential element of marriage, even when such an intention is not expressly manifested. It also addresses the evidentiary challenges involved in these cases and the relevance of conduct, circumstances, and personal convictions in determining the parties' true matrimonial intentions. The chapter concludes that implicit simulation is a particularly relevant legal category for identifying and proving the exclusion of the bonum coniugum.
