Abstract

The framework in which this doctoral thesis is deployed is the Transdisciplinary Ignatian Reconciliation research project of the Comillas Pontifical University, from which we intend to concretize three lines of work: 1. Reconciliation as a horizon and value that emerges from the life of Jesus, and to which he invites his followers. 2. Canonical criminal law as a space in which to work; especially, the sexual abuse of a minor by a cleric 3. The JR as a model of justice that makes reunion possible, that helps to heal, that is committed to peace. This research, necessarily interdisciplinary both because of the framework from which it is developed and because of the implications of this type of crime, presents possible ways for the canonical procedural treatment of the crime against the sixth commandment committed by a cleric against a minor (c. 1398 §1. 1 CIC), from a restorative justice perspective. We seek, through canonical procedural law, to make a way, to create a space in which to lay the foundations that make reconciliation and forgiveness possible. We seek to know in depth the genuine elements of RJ and the legal-canonical instruments that can integrate it. The relevance and interest of the topic lies not only in its social and ecclesial relevance, but, above all, in the need to look at and put in the center those who have suffered this type of abuse and/or aggression, looking for the juridical-canonical measures that make this reality concrete. Putting the victim at the center, listening to her and recognizing her in order to give her back the place that has been taken away from her, implies that the victimizer and the institution assume responsibility for their acts and omissions, that they repair the damage caused and thus restore the relationships damaged by the crime committed. It is necessary to go into these three subjects and their situations in order to be able to make a believing reading of the reality of abuses in the Church and ask ourselves what the Lord is asking of us today, as a Church, in each and every one of these cases, not only at the pastoral, spiritual and theological level, but also at the level that concerns us here: the juridical-canonical level. We have arrived at results that make it possible to establish restorative bases in the canonical penal process, and we have also gathered those that, on the contrary, limit our objective. Finally, we conclude, from the international, national and ecclesiastical normative, the need to have a criminal procedural norm, in the form of a Law of Criminal Procedure, which gathers: 1. Principles of legality and procedural principles for fair trials from which procedural rights and guarantees are derived for both the victim and the victimizer. 2. Criminal courts or sections at the level of the Episcopal Conference or nunciature. 3. Penalties of a mixed nature, with the possibility of medicinal and/or expiatory application. Including the proposal of temporary loss of the clerical state. 4. The inclusion of Restorative Conferences during the preliminary investigation phase. 5. The possibilities of the judge when imposing the penalty of c. 1344.
