Abstract

This paper aims to realize a critical analysis of the growing preeminence of the executive over the legislative in Spain, focusing on the use of the decree-law as a normative instrument. Although Article 86 of the Spanish Constitution establishes that the decree-law is an exceptional instrument that may only be used in situations of “extraordinary and urgent necessity”, its use has steadily increased and it has become a common form of legislation in Spain. First, the paper examines the constitutional framework governing decree-laws and the limits that the Constitution imposes on their use. Second, it analyses the existing mechanisms of control over decree-laws, distinguishing between the political control and the judicial control carried out by the Constitutional Court. The paper then examines the recent practice of decree-laws in Spain, highlighting phenomena such as their increasing use, the deterioration of legislative quality, and the proliferation of “omnibus” decree-laws. Finally, the study proposes possible reforms aimed at strengthening parliamentary oversight and at interpreting more strictly the requirement of extraordinary and urgent necessity, with the objective of preserving the balance between the executive and legislative branches within the constitutional framework.
