Abstract

Restorative Justice is defined and it is explained how it has been incorporated in the contemporary penal system. The contributions of Restorative Justice to the current retributive-adversarial model are explained. Among its different forms of application, victim- offender mediation is chosen to study its characteristics, its procedural stages and the emotional and cognitive phases through which victims and offenders go through. After this, the offenses in which the victim-offender mediation can be used are pointed out, considering the international and the national regulations. Thus, it is observed that victim-offender mediation is nationally forbidden in gender violence offenses by the Organic Law 1/2004 about Comprehensive Protection Measures against Gender Violence. The reasons for this prohibition and its extend are analyzed. Then arguments in favor of victim-offender mediation in gender violence are given, fundamental precautions are established, a modification in the regulation of the restraining order, and it is analyzed how victim-offender mediation in gender violence can be developed within the current legislation. An answer is given to whether the victim and/or the offender in gender violence would necessarily require psychotherapeutic treatment before victim-offender mediation. National experiences on victim-offender mediation are gathered up, and important considerations are given on female victims and male offenders, regarding a complete psychological evaluation prior to victim- offender mediation in gender violence.
