Inconstitucionalidad del Estado de Alarma
Abstract
This paper analyses the different legal alternatives identified by legal experts to deal with the partial unconstitutionality of the first state of alarm declared in Spain on the occasion of COVID-19 through STC 148/2021. This ruling has been the subject of study and debate among legal experts and has led many to point out what the government's strategy for managing the epidemic in Spain should have been. To this end, we study the possible legal paths that could have been followed by analysing the origin of the regulations in order to ascertain the legislator's objective, and therefore verify whether they comply with the intended objective. To this end, on the basis of case law and doctrine, it will be investigated whether the legal system needs to be reformed. Therefore, the aim of the paper is not to point out what the executive should have done in this exceptional situation, but to learn how a similar scenario should be managed in an unforeseeable future for the welfare of society.
