Revisión legal de la patria potestad y las instituciones tutelares

Abstract

Este trabajo de Fin de grado tiene por objeto llevar a cabo un análisis de las instituciones de protección enunciadas en el Código Civil, comparándolas con la regulación acerca de estas formulada en el Anteproyecto de Ley de reforma de Código Civil en materia de discapacidad. Se analizan entonces los principales medios de protección del CC para menores y discapacitados, que son la patria potestad, tutela, la curatela, la guarda de hecho y el defensor judicial; y se señalaran las diferencias mas importantes entre el texto vigente y la propuesta de reforma llevada a cabo en el anteproyecto. Se hará especial énfasis en la protección de los discapacitados, ya que es en este ámbito, en el que se producen las mayores modificaciones.The purpose of this Degree project is to carry out an in-depth analysis of the protection institutions set forth in the Civil Code, comparing them with the regulations on them formulated in the Draft Law on the Reform of the Civil Code in the area of disability. It will then analyze the main means of protection of the CC for minors and the disabled, which are parental authority, guardianship, guardianship, de facto guardianship and the judicial defender; and indicate the most important differences between the current text and the reform proposal carried out in the preliminary draft. Special emphasis will be placed on the protection of the disabled, since it is in this area that the greatest changes have taken place.
