La responsabilidad de proteger a los civiles : análisis de las resoluciones 1973 y 1975 del Consejo de Seguridad

Abstract

La doctrina de la Responsabilidad de Proteger surge como consecuencia de las grandes controversias generadas por el uso de la fuerza en las intervenciones humanitarias durante los años 90, ampliamente criticadas por cuestiones de efectividad, motivaciones, legalidad y legitimidad. En el año 2011 el Consejo de Seguridad aprueba las Resoluciones 1973 y 1975 amparándose en esta norma emergente, con el objetivo de intervenir en Libia y Costa de Marfil tras haberse constatado violaciones de derechos humanos que podrían constituir crímenes contra la humanidad. Este trabajo estudia la implementación de sendas resoluciones para comprobar si se puede decretar la legalidad de las intervenciones en Libia y Costa de Marfil bajo la doctrina de la Responsabilidad de Proteger.The doctrine of the Responsibility to Protect arises as a result of the great controversies generated by the use of force in humanitarian interventions during the 1990s, widely criticized regarding lack ofeffectiveness, motivation, legality and legitimacy. In 2011, the Security Council approved Resolutions 1973 and 1975 based on this emerging norm, with the objective of intervening in Libya and the Ivory Coast after finding violations of human rights that could constitute crimes against humanity. This paper studies the implementation of the resolutions mentioned to verify the legality of the interventions in Libya and Ivory Coast under the doctrine of the Responsibility to Protect.
