Abstract

This research is based on the constitutional right to the free development of personality, enshrined in Article 10 of the Spanish Constitution, in order to configure a general criminal framework regarding the freedom of disposition that individuals have in relation to their own protected legal rights.

In this sense, it analyzes the limits that can be established to this free disposition and the rationale of those. This addresses the operability of the passive subject’s consent to restrict the punishability of certain actions that have the permission of the person who bears them.

In addition, the implications of giving consent and its dogmatic location in the theory of crime are analyzed, as well as its effectiveness requirements are established and its particularities in sexual matters are dealt with.

After having carried out this study, the positions defended throughout the document have been applied to the analysis of sexual consent given in the range between sixteen and eighteen years, where certain interpretative difficulties and legislative uncoordinations were observed.
