“Compliance. Los programas de cumplimiento normativo y la contratación pública”.

Abstract

La Responsabilidad Penal de las Personas Jurídicas ha supuesto la abolición del viejo aforismo societas delinquere non potest y ha reformado los esquemas del ordenamiento jurídico español. Su incorporación implica la necesidad de que las empresas incorporen un programa de cumplimiento normativo o CoCriminal Liability of Legal Persons has led to the abolition of the old maxim societas delinquere non potest and has reformed the schemes of the Spanish legal system. Its inclusion has implied the need for companies to incorporate a compliance program that ensures the company's ethical commitment. However, there is still a long way to go before getting a proper regulation of the requirements that compliance programs must comply with. Little by little, Compliance begins to be reflected in the public procurement as a result of European Union directives and the new laws on administrative procedure. Compliance programs are now presented as a possible exemption from the prohibition of contracting with the Public Administration and in the future, they would surely be also a requirement for access to public procurement.
