The main purpose of this essay is to explain the failure of the TEDH in favor of Inés del Río Prada in the judgment of October 21st of 2013. First of all, a summary of the origin of what is called “doctrina Parot” is done. Then, the case of the etarra of “Comando Madrid” Inés del Río Prada is explained in detail. Afterwards, the arguments of the TEDH related to the judgment are gathered. The dissenting votes related to the 7th article of the CEDH are also brought together. For a better understanding of the case, the interpretations of the jurists have been gathered: Isaac Salama, Juan Antonio García Amado, Jon-‐Mirena Landa Gorostiza y Julián Sánchez Melga. After taking into consideration the jurists´ interpretations, we ask the person who is being interrogated about either the executive or the declarative character of the sentence of the TEDH, which executive character is pretty clear, bringing up uncertainties about the way this sentence was going to be enforce. Then, the material strict justice and the violation of human rights take place in this essay. This essay ends up with an interpretation of the sentence of the TEDH from an ethic point of view.
