El nacimiento del Derecho internacional humanitario y su recepción en España: la Convención de Ginebra de 1864 y la Conferencia Internacional de la Haya de 1899

Abstract

La existencia de conflictos armados ha tenido lugar desde las primeras civilizaciones, y de la misma manera se ha procurado regular el conocido como ius in bellum y el ius ad bellum. No obstante, la primera codificación de las normas de lo que se viene a llamar Derecho Internacional Humanitario se va a producir a lo largo del siglo XIX. Asimismo, tenemos que entender los acontecimientos históricos que anteceden a la citada regulación, que comprenden desde la Unificación Italiana hasta la Guerra de Crimea, con personajes de vital importancia como la enfermera británica Florence Nitinghale.

Pero, sin duda, uno de los mayores precursores de esta rama del Derecho fue Jean-Henri Dunant, fundador de la Organización Internacional de la Cruz Roja, cuya obra Recuerdos de Solferino, en donde encontramos su experiencia en primera persona de los horrores de la guerra, impulsó la creación del conocido como Comité de los Cinco y llevó a la firma de la Convención de Ginebra en agosto de 1864, relativa a mejorar la suerte de los militares heridos en campaña. Treinta y cinco años después se concluía en julio de 1899 la Conferencia Internacional de La Haya relativa a las leyes y usos de la guerra terrestre. Ambos documentos suponen los cimientos del Derecho Internacional Humanitario que conocemos actualmente.

Por último, se analizará la recepción en España de ambos Acuerdos, además del papel de nuestro país en las reuniones señaladas.The existence of armed conflicts has taken place since the first civilizations, and as a consequence, it has been tried to regulate what is known as ius in bellum and ius ad bellum. However, the first codification of the rules of what is called International Humanitarian Law occurred throughout the nineteenth century. Likewise, we have to understand the historical events that precede the aforementioned regulation, ranging from the Italian Unification to the Crimean War, with important characters such as the British nurse Florence Nitinghale.

But, undoubtedly, one of the greatest precursors of this branch of law was Jean-Henri Dunant, founder of the International Organization of the Red Cross, whose work A memory of Solferino, where we find his experience facing the horrors of the war, promoted the creation of the so-called Committee of the Five and led to the signing of the Geneva Convention in August 1864, for the Amelioration of the Condition of the Wounded in Armies in the Field. Thirty-five years later, the International Conference of The Hague with respect to the Laws and Customs of War on Land was concluded in July 1899. Both documents represent the foundations of International Humanitarian Law that we know today.

Finally, we will analyze the reception in Spain of both Agreements, as well as the role of our country in the aforementioned meetings.
