Abstract
La cuestión es: ¿puede una “resolución” justificar limitaciones de derechos fundamentales? Pues bien, según jurisprudencia constitucional consolidada, los derechos fundamentales son aquellos que se ejercen frente a los poderes públicos. Pero para que un Gobierno pueda restringirlos, tiene que ampararse en una ley orgánica que se lo permita; aunque no de manera genérica.
