La prevención de la nulidad del matrimonio

Abstract

En cualquier orden de la vida, suele ser mejor adelantarse y prevenir un mal que tener que enfrentar las consecuencias del mismo, lo cual fácilmente es trasladable al ámbito jurídico; ésta es la razón por la que el legislador, respecto de los juicios en general, establece en el can. 1446 § 1 que «todos los fieles, y en primer lugar los obispos, han de procurar con diligencia que, sin perjuicio de la justicia, se eviten en lo posible los litigios en el pueblo de Dios y se arreglen pacíficamente cuanto antes»; este criterio que el legislador establece para los juicios en general encuentra también traducción en el ámbito de los procesos de nulidad del matrimonio, en concreto en el nuevo can. 167 5, que establece que «el juez, antes de aceptar una causa, debe tener la certeza de que el matrimonio haya fracasado irreparablemente, de manera que sea imposible restablecer la convivencia conyugal» 2 . Con este presupuesto, quizás conviene hacer una apunte inicial a propósito del título de esta ponencia -«la prevención de la nulidad del matrimonio»-, apunte que en cierto modo tiene que ver con los diversos sentidos con que usamos el término «nulidad»: aquello que ha de ser objeto de prevención es el matrimonio nulo, no los procesos de nulidad. 1 Decano del Tribunal de la Rota. 2 Este nuevo can. 1675 tiene algún matiz que lo diferencia del antiguo can. 1676, que establecía lo siguiente: «antes de aceptar una causa y siempre que vea alguna esperanza de éxito, el juez empleará medios pastorales para inducir a los cónyuges si es posible a convalidar su matrimonio y a restablecer la convivencia conyugal». 52 Carlos Manuel MoRÁN BUSTOS En efecto, el proceso de nulidad en sí, y los procesos concretos de nulidad, también en sí, por su propia naturaleza declarativa, no son ningún mal para la vida de la Iglesia, más bien lo contrario, son «un instrumento para certificar la verdad sobre el vínculo conyugal. Por consiguiente, su finalidad constitutiva no es complicar inútilmente la vida a los fieles, ni mucho menos fomentar su espíritu contencioso, sino sólo prestar un servicio a la verdad. .. El proceso es instrumento cualificado para cumplir el deber de justicia de dar a cada uno lo suyo ... ningún proceso es contra la otra parte, como si se tratara de infligirle un daño injusto. Su finalidad no es quitar un bien a nadie, sino establecer y defender la pertenencia de los bienes a las personas y a las instituciones. En la hipótesis de nulidad matrimonial.. .no hay algún bien sobre el que disputen las partes y que deba atribuirse a una o a otra. En cambio, «el objeto del proceso es declarar la verdad sobre la validez o invalidez de un matrimonio concreto, es decir, sobre una realidad que funda la institución de la familia y que afecta en el máximo grado a la Iglesia y a la sociedad civil» 3 • Al final de ese mismo Discurso a la Rota romana de 2006, el Papa Benedicto XVI hacía una referencia que nos sirve para delimitar el ámbito de nuestra reflexión: «la sensibilidad pastoral debe llevar a esforzarse por prevenir las nulidades matrimoniales cuando se admite a los novios al matrimonio y a procurar que los cónyuges resuelvan sus posibles problemas y en~uentren el camino de la reconciliación» 4 . Esto es lo que hay que prevenir: los matrimonios nulos y, si fuera posible, los matrimonios fracasados, conscientes de que es mejor prevenir un matrimonio nulo que deber declararlo como tal, ya que el hecho de que sea nulo, y la nulidad declarada, no suprime las vivencias de las personas, el daño y el sufrimiento para sí y para terceros ( especialmente los hijos, y también los padres) directamente relacionados con ellos. Sobre esta idea, la tesis que defendemos como base de toda nuestra reflexión es que no hay medio mejor y más eficaz para evitar la nulidad del matrimonio -y también para evitar muchos fracasos conyugales- que una seria, rigurosa y profunda preparación al matrimonio. La prevención de la nulidad del Matrimonio 53 del consentimiento y preparación al matrimonio; 3º/ Preparación remota, próxima e inmediata al matrimonio; 4°/ Capacidad psíquica y preparación al matrimonio; 5°/ Voluntad simuladora y preparación al matrimonio; 6º/ Fe y celebración del matrimonio.In any area of life, it is usually better to anticipate and prevent a harm than to face the consequences of it, which can easily be applied to the legal field; this is the reason why the legislator, regarding lawsuits in general, establishes in canon 1446 § 1 that "all the faithful, and above all the bishops, must diligently strive, without prejudice to justice, to avoid litigation in the people of God and to settle matters peacefully as soon as possible"; this principle established by the legislator for lawsuits in general also applies to the process of nullity of marriage, specifically in the new canon 1675, which states that "the judge, before accepting a case, must be certain that the marriage has irreparably failed, so that it is impossible to restore marital coexistence." With this premise, it may be worth making an initial note regarding the title of this paper—"the prevention of the nullity of marriage"—a note that is somewhat related to the different senses in which we use the term "nullity": what must be prevented is the invalid marriage, not the annulment processes. Indeed, the process of nullity itself, and the specific annulment cases, by their very declarative nature, are not a harm to the life of the Church, quite the opposite, they are "an instrument to certify the truth about the marital bond." Consequently, their constitutive purpose is not to unnecessarily complicate the lives of the faithful, nor to foster a contentious spirit, but only to serve the truth... The process is a qualified instrument to fulfill the duty of justice in giving each one their due... No process is against the other party, as if it were intended to inflict an unjust harm. Its purpose is not to take something from anyone, but to establish and defend the belonging of goods to individuals and institutions. In the case of marital nullity... there is no asset that the parties dispute and that must be assigned to one or the other. Instead, "the object of the process is to declare the truth about the validity or invalidity of a specific marriage, that is, about a reality that forms the foundation of the institution of the family and that affects the Church and civil society to the highest degree." At the end of that same 2006 Discourse to the Roman Rota, Pope Benedict XVI made a reference that helps delimit the scope of our reflection: "pastoral sensitivity must lead to efforts to prevent marital nullities when admitting couples to marriage and to seek that the spouses resolve their possible problems and find the way to reconciliation." This is what needs to be prevented: null marriages and, if possible, failed marriages, aware that it is better to prevent a marriage from being declared null than to declare it so, since the fact that it is null, and the declaration of nullity, does not erase the experiences of the individuals, the harm, and the suffering for themselves and for others (especially children, and also the parents) directly related to them. On this idea, the thesis we defend as the basis of all our reflection is that there is no better and more effective means to avoid the nullity of marriage—and also to avoid many marital failures—than a serious, rigorous, and thorough preparation for marriage. To talk about the prevention of marital nullity, I will refer to the following issues: 1) Etiology of marital breakdowns-crises; 2) Admission to marriage and ius connubii; 3) Centrality of consent and preparation for marriage; 4) Remote, proximate, and immediate preparation for marriage; 5) Psychological capacity and preparation for marriage; 6) Simulated will and preparation for marriage; 7) Faith and marriage celebration.
