El tratamiento penitenciario: concepto, sentido y límites

Abstract

En el presente trabajo se llevará a cabo una revisión -parcial- de la literatura existente del concepto de tratamiento penitenciario. Se comenzará exponiendo lo que suministra la norma y la jurisprudencia a nivel conceptual legal sobre el mismo. Para después, comprobar si realmente se recoge dicha conceptualización a nivel práctico en los programas actuales de las instituciones penitenciarias. Por último, se mencionarán aquellos límites que restringen el alcance del tratamiento penitenciario.This paper will carry out a partial review of the existing literature on the concept of penitentiary treatment. It will begin by explaining what the law and jurisprudence provide at a legal conceptual level. We will then check whether this conceptualization is reflected in practice in the actual programmes of penitentiary institutions. Finally, the limits which restrict the scope of prison treatment will be mentioned.
