Comparativa entre las garantías flotantes españolas y la floating charge anglosajona

Abstract

Esta investigación se centra en el estudio comparativo de la prenda flotante en la legislación española y la floating charge anglosajona del ordenamiento inglés. Se pretende analizar la adecuación de la flotabilidad del objeto de la prenda a la realidad económico-financiera, y verificar las semejanzas y discrepancias existentes entre ambos ordenamientos en esta materia, a fin de extraer conclusiones válidas que permitiesen al ordenamiento español una mayor adaptación a la realidad económica actual.

This research focuses on a comparative study between floating pledges under the Spanish legislation and the Anglosaxon floating charge of the English Common Law system. The intent is to assess the alignment between the floatability of the object granted as pledge and the economic-financial reality, and verify the similarities and discrepancies existing between both legal systems in this matter, in order to draw valid conclusions that would allow the Spanish legal system a greater adaptation to the current economic reality.
