Protección del deudor hipotecario

Abstract

En el siguiente trabajo se estudiará cómo y qué medidas se aplicaron y se aplican en aras de proteger al deudor hipotecario frente a la posición, en ocasiones abusiva, del acreedor futuro o posible ejecutante a la hora de celebrar un contrato de préstamo o crédito. En primer término, expongo, en el contexto de la evolución de la crisis inmobiliaria que sufrió España y los demás países de Occidente a comienzos de este siglo, desde el 2008 en adelante, las consecuencias que se derivaron de la explosión de la “burbuja especulativa” junto con la normativa vigente en aquel momento. Posteriormente, paso a analizar las numerosas medidas protectoras que trataron de resolver los graves problemas que se suscitaron en la sociedad, fundamentalmente en las clases sociales más desfavorecidas y en las clases medias, teniendo como objetivo colmar, de manera urgente, las lagunas legislativas que en este ámbito se producían. Es por ello por lo que, a continuación, examino las distintas aportaciones que cada una de ellas supuso en la lucha contra la desprotección del más débil de la relación jurídica, con especial atención a las recogidas en la Ley 1/2013, de 14 de mayo. Finalmente, llevo a cabo una amplia investigación jurisprudencial a cerca de las cláusulas abusivas con base en lo dispuesto en la Ley General de Consumidores y Usuarios y la Directiva 93/13 CEE.The following research will study how and what measures were applied and apply in order to pursue the protection of the mortgagor against the position, sometimes, abusive of the future mortgagee or possible executor when entering into a loan or credit agreement. First of all, I expose, in the context of the evolution of the real estate crisis suffered by Spain and the West Countries at the beginning of this Century, from 2008 and onwards, the consequences derived from the explosion of the "speculative bubble" together with the regulations in force at that time. Subsequently, I analyze the multiple protective measures that sought to solve the serious problems that arose in the society, mainly in the most disadvantaged social classes and in the middle classes, with the aim of bridging urgently the legislative gaps triggered in this area. For this reason, consecutively, I examine the different contributions that each of them entailed in the fight against the lack of protection of the weakest of the legal relationship, with special attention to those included in the Law 1/2013, of 14 May. Finally, I carry out an extensive jurisprudential investigation about the abusive clauses based on the provisions of the General Law of Consumers and Users and Directive 93/13 CEE.
