Asentamientos israelíes y la población palestina: un breve análisis de Derechos Humanos en Cisjordania

Abstract

Breve análisis de la situación humanitaria en el territorio ocupado palestino por parte de las autoridades israelíes, realizando un recorrido por la historia del pueblo judío y su presencia en el territorio. Comenzando por el contexto histórico, desde el éxodo de la Palestina histórica, pasando por el Imperio Otomano, las dos Guerras Mundiales y cómo éstas dispararon la inmigración judía a la Palestina histórica. Realizando una conexión entre la inmigración judía, el fenómeno de los kibbutz y su influencia en la sociedad israelí hoy en día y los asentamientos israelíes derivados de la mentalidad colona. Analizando las motivaciones detrás de los asentamientos y sus implicaciones, las ideologías y el apoyo tanto legal como económico por parte del gobierno israelí. Explicando el marco legal por el que se rigen los asentamientos, analizando así su legalidad en el plano nacional israelí y en el plano internacional, la distribución estratégica de éstos dentro del territorio ocupado, y finalmente, realizando un estudio de cómo afectan a los derechos humanos de la población palestina. En cuanto a los DDHH, se analiza el marco legal en el que se rigen a nivel internacional, las responsabilidades de Israel como Potencia Ocupante y se explica cómo las distintas restricciones violan un gran abanico de derechos humanos, civiles, sociales, económicos y políticos, aportando ejemplos de los Artículos y casos específicos.Brief analysis of the humanitarian situation in the Occupied Palestinian Territory and the effects of the presence of the Israeli authorities, carrying out an explanation of the Jewish history and their presence in the territory. The historical context carries out an analysis which dates back to the exodus from historical Palestine, the Ottoman Empire, both World Wars and how these influenced the skyrocketing of the Jewish immigration in Palestine. Analyzing the connection between Jewish immigration, the kibbutz phenomena and their influence in modern day Israeli society and Israeli settlements derived from the colonial mentality. Carrying out a brief analysis of the motivations behind settlements and the implications of such motivations, as well as the ideologies and economic and legal support given by the Israeli government. Explanation of the legal framework by which the settlements are ruled, analyzing their legality in the national Israeli context as well as the international context, explaining their strategic distribution within the Occupied territories. Finally, carrying out an analysis of how said settlements have an impact in Palestinian Human Rights. In order to understand it, it is crucial to mention the legal framework which rules HHRR at an international level, as well as the Israeli obligations as the Occupying Power. Taking these into consideration, it is explained how the measures applied by the Israeli authorities systematically violate a great range of civile, social, economic and political Palestinian Human Rights, providing specific rights and cases.
