Autores ausentes y obras huérfanas

Abstract

En el Estudio sobre las limitaciones y excepciones al derecho de autor en beneficio de bibliotecas y archivos elaborado en la Decimoséptima sesión (Ginebra, 3 a 7 de noviembre de 2008) del Comité permanente de derechos de autor y derechos conexos de la OMPI se define la obra huérfana como «obras protegidas por derecho de autor, cuyos titulares no pueden ser identificados o localizados». Una obra huérfana es aquella que, siendo susceptible de protección, su titular no está identificado, o estándolo, no esta localizado. Así, hay dos posibilidades de entender la obra huérfana: - que no se sabe quién es el padre, - que se sabe quien es el padre, pero no se puede localizar al titular de los derechos.

De esta forma: - la obra es susceptible de protección porque se trata de una creación original, literaria, artística o científica expresada por cualquier medio o soporte tangible o intangible (art. 10 LPI). Igualmente puede tratarse de una obra derivada (art. 11 LPI), una colección de obras ajenas, de datos o de otros elementos independientes y las bases de datos de acuerdo con el art. 12 LPI. Cualquier obra puede ser una obra huérfana como por ejemplo una fotografía o un diagrama. Deben ser obras susceptibles de protección, es decir que están protegidas. La obra huérfana está en el dominio privado, no en el público. No se trata de algo de todos, sino de algo de alguien: una obra huérfana puede ser como un teléfono que se encuentra en un taxi olvidado por un usuario anterior. El teléfono es de alguien, no está ahí para el libre disfrute de quien se lo encuentra.

- no está identificado el titular o estándolo, no está localizado. Se trata del titular de los derechos, no necesariamente del autor, pues puede tratarse de sus herederos o incluso un titular que puede ser una institución. Para esto además hay que recordar la duración de los derechos de explotación es de «toda la vida del autor y setenta años después de su muerte o declaración de fallecimiento» (art. 26 LPI) y en el caso de obras anónimas y seudónimas, los derechos de explotación durarán 70 años desde su divulgación lícita (art. 27 LPI). «Cuando antes de cumplirse este plazo fuera conocido el autor, bien porque el seudónimo que ha adoptado no deje dudas sobre su identidad, bien porque el mismo autor la revele, será de aplicación lo dispuesto en el artículo precedente» (art. 27 LPI).The Study on Copyright Limitations and Exceptions for the Benefit of Libraries and Archives prepared at the Seventeenth Session (Geneva, 3-7 November 2008) of the Standing Committee on Copyright and Related Rights of WIPO Orphan work as "works protected by copyright, whose owners can not be identified or located". Any work can be an orphaned work such as a photograph or a diagram. They must be works susceptible of protection, that is to say that they are protected. The orphaned work is in the private domain, not in the public. It is not something of everyone, but something of someone: an orphaned work can be like a telephone that is in a taxi forgotten by a previous user. The phone belongs to someone, it is not there for the free enjoyment of those who find it.

- the holder is not identified or is not located. It is the owner of the rights, not necessarily the author, because it may be his heirs or even a holder that can be an institution. To this end, it should be remembered that the duration of the exploitation rights is "the author's entire life and 70 years after his death or declaration of death" (Article 26 LPI) and in the case of anonymous and pseudonymous works, Exploitation rights will last 70 years from its legal disclosure (Article 27 LPI). "When the author is known before the deadline, either because the pseudonym he has adopted does not leave doubts about his identity, or because the same author reveals it, the provisions of the preceding article will apply" (Article 27 LPI) .
