Abstract

La reducción de las rentas procedentes de la cesión determinados activos intangibles, recogida en el artículo 23 de la LIS, busca fomentar que las entidades lleven a cabo actividades de I+D+i, así como incentivar la transferencia de tecnología. En este sentido, el artículo 23 de la LIS recoge una lista cerrada de activos intangibles susceptibles de beneficiarse de la reducción del artículo 23 de la LIS, y excluye otra serie de activos que en ningún caso darán derecho a la reducción. Así, este régimen permite al contribuyente, si se cumplen con los requisitos recogidos en el citado artículo, realizar un ajuste negativo al resultado contable por el importe resultante de multiplicar el porcentaje del coeficiente de reducción a la renta positiva que se ha generado por la cesión de los activos intangibles. Este régimen se ha adaptado al Plan de Acción 5 de la OCDE, cumpliendo con los requisitos de sustancia y transparencia, para evitar que la aplicación de regímenes preferenciales, como el Patent Box, socavaran los principios de competencia fiscal. Por tanto, más de la mitad de países de la Unión Europea que tienen vigente el régimen de Patent Box, cumplen con los requisitos del Plan de Acción.
