Abstract

Since the enactment of the CC, there have been attempts aimed at reforming the reserved portion of inheritance and advances intended to promote the right to freedom of testament. However, there are still a large number of laws protecting this legal institution through the establishment of the causes of disinheritance as numerus clausus and the preservation of the limits imposed on testamentary freedom. The configuration or model of the family have changed significantly. Nonetheless, the interpretation of existing legal norms is not always in accordance with the social reality of the moment in which they are applied. Traditionally, doctrine and jurisprudence have adopted a strict approach to the interpretation of the causes of disinheritance of children and descendants, in which neither analogy nor extensive interpretation is accepted. Exceptionally, the most recent decisions of the Supreme Court have been introducing certain flexibility in their interpretation and, specifically, in the consideration of the mistreatment, by including within this concept the psychological mistreatment, as a cause of disinheritance of children and descendants. The situation that has arisen as a consequence of COVID-19 and the most recent jurisprudence in this matter, provide an opportunity to modify the interpretation that should be made of the causes of disinheritance. They are the impulse for the legislator to value once again and contemplate as new causes of disinheritance of children and descendants, the different behaviors and actions that have occurred during the confinement. Mainly in relation to lack of care and attention during this period. The fact that the CCCat by Law 10/2008, of July 10, 2008, has chosen to incorporate as a new cause of disinheritance “the manifest and continuous absence of family relationship between the deceased and the legitimate beneficiary” (“la ausencia manifiesta y continuada de relación familiar entre el causante y el legitimario”), is an additional step for the legislator to incorporate this new cause of disinheritance to the CC. It is necessary to review, update or even reform the CC in the field of inheritance law and, in particular, with regard to the causes of disinheritance.
