Las nuevas necesidades de protección de las personas de edad avanzada. Una aportación desde el Derecho civil

Abstract

Los cambios sociales debidos a la mejora en el cuidado de la salud y el aumento de la esperanza de vida, han provocado que la situación de los ancianos haya variado en los últimos tiempos respecto a la anterior. Además, la nueva configuración de la estructura familiar, pasando de un grupo amplio a una familia nuclear, conlleva que los mayores se vean necesitados de nuevos sistemas de protección. La sociedad y, consiguientemente, el Derecho han de buscar nuevas formas de cuidado del anciano. Tradicionalmente, dicho cuidado recaía en sus parientes más cercanos, pero ello es cada vez menos frecuente, por lo que el interés pasa a centrarse en las posibilidades de autoprotección, tanto personal como económica, de una parte, y en las responsabilidades que ha de asumir el conjunto de la sociedad, por otra. Atendiendo al ordenamiento jurídico actual, podemos ver que existen dos conjuntos de herramientas para asistir al mayor necesitado de protección. Por un lado, las destinadas a proveer de ayuda económico-patrimonial, como el contrato de renta vitalicia o la hipoteca inversa. Por otro lado, las que van más allá y pretenden también extender esta protección al ámbito personal, como el apoderamiento preventivo, que permite hacer previsiones encaminadas a la protección tanto en el ámbito patrimonial como en el personal. Sin embargo, y aunque pueda parecer que con estas instituciones el anciano goza de un amplio abanico de medidas protectoras, es lo cierto que aún quedan múltiples facetas que desarrollar y avances por llevar a término. A pesar de la valoración positiva que debe darse a la normativa implementada por el legislador a partir del año 2003, ha de continuar mejorándose la regulación de los instrumentos existentes, así como elaborar medidas de protección específicas para los ancianos. Todos estos instrumentos deben incorporar no solo recursos públicos sino también privados, para asegurar que el sistema permita una protección lo más amplia posible.Social changes, due to improved health care and increased life expectancy, have meant that the situation of the elderly has changed in recent times. Society and, consequently, the law must seek new forms of care for the elderly. Traditionally, such care was provided by the closest relatives, but this is becoming less and less frequent, so the focus is now on the possibilities of self-protection, on the one hand, and on the responsibilities to be assumed by society as a whole, on the other. Looking at the current legal system, we can see that there are two sets of tools to assist the elderly in need of protection. On the one hand, those aimed at providing economic and patrimonial assistance, such as the life annuity contract or the reverse mortgage. On the other hand, those that go further and also seek to extend this protection to the personal sphere, such as the preventive power of attorney, which makes it possible to make provisions for protection in the patrimonial and personal spheres. However, and although it may seem that with these institutions the elderly enjoy a wide range of protective measures, it is true that there are still many facets to be developed and advances to be made. In spite of the positive evaluation that should be given to the regulation implemented by the legislator since 2003, the regulation of the existing instruments must continue to be improved, as well as the elaboration of specific protective measures for the elderly.
