Abstract

Gracias a los avances tecnológicos de las últimas décadas, la ciencia, y con ella el ser humano, ha logrado descubrir y conquistar fronteras hasta ahora inaccesibles. Una de estas fronteras ha sido el fondo marino. El reciente desarrollo de la arqueología submarina nos ha permitido recuperar la parte de nuestra historia que permanecía oculta bajo las olas. Estos nuevos objetos, tanto muebles como inmuebles, que han sido hallados y extraídos han pasado a formar parte del patrimonio histórico de España. Cabe entonces preguntarse cual ha sido la reacción del legislador ante esta nueva realidad. Mientras que antes las normas y leyes no mostraban gran interés a la protección del patrimonio cultural subacuático, la reciente accesibilidad a estos bienes ha generado una necesidad de regulación sobre esta materia. El patrimonio cultural subacuático se ha convertido en una verdadera realidad histórica y jurídica. De esta forma, es importante analizar la efectividad y el alcance de la protección jurídica de los bienes sumergidos que se desprende de nuestro Ordenamiento Jurídico. Por último, también resulta conveniente estudiar la posible necesidad de aprobar normas más específicas en materia de protección del patrimonio cultural subacuático.Thanks to technological advances in recent decades, science, and thus humanity, has managed to discover and conquer previously inaccessible frontiers. One of these frontiers has been the seabed. The recent development of underwater archaeology has allowed us to recover the part of our history that remained hidden beneath the waves. These new objects, both movable and immovable, which have been found and extracted, have become part of Spain's historical heritage. It is then worth asking what the legislator's reaction has been to this new reality. Whereas before, rules and laws showed little interest in protecting underwater cultural heritage, the recent accessibility to these assets has generated a need for regulation in this matter. Underwater cultural heritage has become a true historical and legal reality. Therefore, it is important to analyze the effectiveness and scope of the legal protection of submerged assets arising from our Legal System. Finally, it is also advisable to study the possible need to approve more specific rules regarding the protection of underwater cultural heritage.
