El Derecho a un medio ambiente limpio y sostenible: ¿Un Derecho Humano con entidad propia?

Abstract

El objetivo de este trabajo es analizar la protección ofrecida por el Derecho Internacional al medio ambiente para poder determinar así si existe un derecho humano a un medioambiente limpio, sostenible y sano. Para ello empezaremos analizando el concepto general de derechos humanos, su evolución histórica, sus características, la protección que se ofrece a los mismos en el Derecho Internacional y qué obligaciones tienen los Estados en relación a su cumplimiento. Después, procederemos a analizar la protección ofrecida al medioambiente en el sistema internacional y los sistemas regionales de protección de derechos humanos. El análisis general del concepto de derechos humanos y el análisis más concreto de la protección del medioambiente nos permitirá comprender y determinar, en el último apartado, si el derecho a un medioambiente sano cuenta con las características suficientes para ser considerado un derecho humano.The aim of this paper is to analyze the protection offered by International Law to the environment in order to determine whether there is a human right to a clean, sustainable and healthy environment. To do so, we will begin by analyzing the general concept of human rights, their historical evolution, their characteristics, the protection offered to them in International Law and what obligations States have in relation to their fulfilment. We will then proceed to analyze the protection offered to the environment in the international and regional systems for the protection of human rights. The general analysis of the concept of human rights and the more specific analysis of environmental protection will allow us to understand and determine, in the last section, whether the right to a healthy environment has sufficient characteristics to be considered a human right.
