Abstract

As a legal institution protecting the interests of individuals against the actions of the Public Administrations, the patrimonial liability is configured in our Law as a constitutional guarantee that recognizes the right of citizens to be compensated for the damages suffered by them due to the actions of the public authorities. This paper offers an in-depth analysis of the Spanish regime of patrimonial liability in the context of the crisis caused by the COVID-19, specifically in the first months of the pandemic that led to the declaration of the (first) state of alarm in Royal Decree 463/2020. During this state of emergency, Spanish citizens, workers and companies suffered an enormous amount of economic and personal damage as a consequence of the measures adopted by the Public Administrations, in particular by the General State Administration. In view of the fact that many of these injured parties are expected to seek compensation through the patrimonial responsibility for the management of the pandemic during the first state of alarm, this research has sought to delve into the most controversial aspects that these claims will have to face. With this objective, the work is based on several scenarios in which the patrimonial liability could have been compromised in order to subsequently analyze the problems that these present due to the particular legal regulation of the patrimonial liability and in the light of the jurisprudence in this subject, especially that of the Spanish Constitutional Court on the first state of alarm. Finally, our forecasts on the future of these liability claims will be presented.
