La protección de los hijos menores de edad en las crisis matrimoniales

Abstract

Este trabajo tiene como fin analizar la protección del hijo menor en las distintas crisis matrimoniales. En un inicio se tratará el concepto del interés superior del menor como fundamento de tal protección y el derecho de audiencia del menor. Posteriormente se analizará la protección del mismo en las diversas fases de los procesos judiciales, desde antes de la interposición de la demanda, durante la tramitación del proceso y una vez se ha dictado la sentencia judicial tras el proceso judicial de nulidad, separación o divorcio. Por último, se estudiarán los diversos efectos que derivan de la crisis matrimonial, concretamente la patria potestad y el régimen de guarda y custodia, el derecho de visita y comunicación, la atribución del uso de la vivienda familiar y la pensión de alimentos.This work will try to carry out an investigation about the protection of the minor in marital crisis. Initially, the concept of the best interests of the minor will be treated as the basis for such protection and the right of hearing of the minor. Subsequently, the protection of the same will be analyzed in the various phases of the judicial processes, from before the filing of the lawsuit, during the processing of the process and once the judicial sentence has been handed down after the judicial process of nullity, separation or divorce. Finally, the various effects derived from the marriage crisis will be studied, specifically parental authority and the custody and custody regime, the right of visit and communication, the attribution and the use of the family home and alimony.
