Justicia restaurativa y cuestiones de política criminal

Abstract

During the Spanish Civil War and Franco’s dictatorship countless crimes against human rights were committed. The repression exercised by the State and the social discrimination was the direct cause which generated that many griefs and traumas, originated during this historical period, are remained unsolved nowadays. This situation was the direct reason of their encapsulation. The individuals who suffered this encapsulation, unconsciously, transmitted to their children the symptoms and emotions resulted from the lack of repairment. This phenomenon is known in the field of psychogenealogy as the generational transmission of trauma. This transmission causes many negative effects in our current society, an example is the extreme ideological polarization of the spanish population. To overcome this state of victimization, a collective memory based on the truth must be created, this is the only way to forgive the injustices committed in the past. In order to achieve this atonement, it is proposed to follow the parameters of restorative justice and international law. In addition, it is important to develop individual, but also group and collective work in search of forgiveness where it is highly important that the State plays a significant role.
