dc.description.abstractEl presente trabajo analiza la protección de la intimidad del menor ante la creación de su huella digital mediante un análisis comparado de los ordenamientos jurídicos español y peruano. A través del estudio de sus marcos constitucionales, normativos y jurisprudenciales, se examinan los mecanismos de tutela disponibles en cada sistema, sus fortalezas y sus déficits, aplicando seis parámetros comunes: edad y régimen de consentimiento, fundamento constitucional, tutela civil, tutela administrativa, protección frente a la exposición parental no consentida y eficacia real del sistema. El análisis revela que ambos ordenamientos comparten los mismos vacíos normativos estructurales (ausencia de regulación específica de la exposición parental no consentida, ineficacia de los mecanismos de verificación de edad y limitaciones frente a plataformas transfronterizas) si bien España presenta una mayor densidad normativa e institucional que Perú. Se concluye que la protección del menor en el entorno digital no es un problema de falta de voluntad normativa sino de eficacia real, y se propone un estándar mínimo común articulado en torno a seis principios: prioridad del interés superior del menor, verificación efectiva de la edad, límites a la representación parental, garante institucional independiente, responsabilidad reforzada de las plataformas y educación digital como pilar preventivo.es-ES
dc.description.abstractThis study analyses the protection of minors' privacy in the context of their digital footprint through a comparative study of the Spanish and Peruvian legal systems. By examining their constitutional, regulatory and jurisprudential frameworks, the available protection mechanisms in each system are assessed, along with their strengths and shortcomings, applying six common parameters: age and consent regime, constitutional foundation, civil protection, administrative protection, protection against non-consensual parental exposure and the real effectiveness of the system. The analysis reveals that both legal systems share the same structural normative gaps (the absence of specific regulation of non-consensual parental exposure, the ineffectiveness of age verification mechanisms and limitations in dealing with cross-border platforms ) although Spain presents a greater normative and institutional density than Peru. It is concluded that the protection of minors in the digital environment is not a problem of lack of normative will but of real effectiveness, and a minimum common standard is proposed, articulated around six principles: the primacy of the best interests of the child, effective age verification, limits on parental representation, an independent institutional guardian, reinforced platform liability and digital education as a preventive pillar.en-GB
