El Derecho como discurso : una perspectiva foucaultiana

Abstract

The aim of this dissertation is to understand, through Michel’s Foucault deductive reasoning, two main points: the existing interaction between Law and the noninstitutionalized normative systems, and the power relationships between groups and individuals. The conclusion will be that actually the juridical system can face up these complexities through either authorizing the use of disciplinary power or, on the contrary, counteracting it. This analytical method will help us to fit Law within what we may consider as a Chinese box of power, pointing up not to regard it from an essentialist point of view and keeping from the long dated issue of sovereignty. First of all we will focus on the disciplinary power in order to understand its interactions with the legal power. Therefore, we will secondly analyse the two different possibilities of interactions between these powers through the examples of Social and Labour Law, and Migration Law.
