La defensa del interés superior del menor en el sistema español de responsabilidad penal del menor

Abstract

El interés superior del menor se erige como la piedra angular del sistema español de responsabilidad penal del menor. No obstante, a lo largo de la historia ha sido considerado un concepto indeterminado y desconsiderado. En 2015 se reforma la ley de protección jurídica del menor y se introduce una definición completa del interés superior del menor, así como los criterios generales para determinarlo. Sin embargo, en el sistema de responsabilidad penal del menor, no ha habido ninguna reforma que adapte el sistema al nuevo concepto de interés superior del menor. Por consiguiente, realizamos un análisis de la legislación anterior a la ley de responsabilidad penal del menor, para comprender qué se entendía por interés superior del menor, cuando todavía no existía una definición completa de este concepto. Una vez comprendemos el sentido del interés superior del menor desde el punto de vista penal, analizamos la defensa que se hace del mismo en el procedimiento penal. Concluimos el trabajo, proponiendo diferentes soluciones para poder armonizar, el nuevo concepto de interés superior del menor con el sistema español de responsabilidad penal del menor.The best interests of the child is the cornerstone of the Spanish system of criminal responsibility of minors. However, over the years it has been considered an indeterminate and unconsidered concept. In 2015, the law on the legal protection of minors was reformed and a complete definition of the best interests of the minor was introduced, as well as the general criteria to determine it. However, in the system of criminal responsibility of minors, there has been no reform to adapt the system to the new concept of the best interests of the child. Therefore, we carried out an analysis of the legislation prior to the law on criminal responsibility of minors, in order to understand what was preconceived as the best interests of the minor, when there was still no complete definition of this concept. Once we understand the meaning of the best interests of the minor from a criminal point of view, we analyse the defence of the best interests of the minor in criminal proceedings. We conclude the work by proposing different solutions to harmonise the new concept of the best interests of the child with the Spanish system of criminal responsibility of minors.
