La responsabilidad de las administraciones públicas derivada de la pandemia del COVID-19

Abstract

La pandemia del COVID-19 ha supuesto un reto político, social, económico y, por supuesto, jurídico. Las implicaciones jurídicas que han surgido a consecuencia de esta enfermedad no son pocas ni menores. Entre ellas, destaca la controversia acerca de la posibilidad de que una institución bien conocida entre nosotros, como es la responsabilidad patrimonial de las Administraciones Públicas, despliegue sus efectos por la gestión que los poderes públicos han llevado a cabo en su lucha contra la referida pandemia. Los supuestos en que a lo largo de esta crisis sanitaria se ha podido pensar en aplicar la referida institución han sido numerosos y variados. El objetivo de este trabajo es analizar si tiene encaje en cada uno de ellos. Pero, quizás, previamente debemos deslindar la institución de la responsabilidad patrimonial de otras similares con las que tiene en común su carácter patrimonial pero de la que le separan importantes diferencias.

The COVID-19 pandemic has been a political, social, economic and, of course, legal challenge. The legal implications that have arisen as a result of this disease are neither few nor minor. Among them, the controversy about the possibility that an institution well known among us, such as the patrimonial responsibility of the Public Administrations, unfolds its effects due to the management that the public powers have carried out in their fight against the aforementioned pandemic stands out. . The assumptions in which throughout this health crisis it has been possible to think of applying the aforementioned institution have been numerous and varied. The objective of this work is to analyze if it fits in each of them. But, perhaps, previously we must separate the institution of patrimonial responsibility from other similar ones with which it has in common its patrimonial character but from which it is separated by important differences.
