La ley aplicable en el arbitraje internacional comercial: convenio arbitral, procedimiento y controversia

Abstract

El arbitraje internacional es una institución que ha experimentado una importante evolución en los últimos años. El colapso de los órganos judiciales y las ventajas del arbitraje – como la especialización, confidencialidad, rapidez, etc – frente al proceso judicial ha supuesto un incremento de casos sometidos a esta institución. Esto ha dado lugar a un mayor desarrollo legislativo del arbitraje internacional, así como la creación de nuevas sedes arbitrales internacionales. Sin embargo, la determinación del Derecho aplicable en las distintas etapas del arbitramento: convenio arbitral, controversia y procedimiento; sigue siendo causa de conflicto en los procesos arbitrales. La Ley 60/2003, inspirada en la Ley Modelo UNCITRAL, regula el arbitraje de forma unitaria y pretende solucionar dichos problemas apostando por criterios flexibles para determinar la validez del convenio arbitral, abogando por la prudencia del árbitro o árbitros, limitando la aplicación del Derecho elegido por las partes al orden público y minimizando la intervención judicial al procedimiento arbitral. Además, el ordenamiento español cuenta con dos instrumentos internacionales de arbitraje de referencia: el Convenio de Nueva York de 1958 y la Convención de Ginebra de 1961. Ambos han sido y siguen siendo dos instrumentos arbitrales de referencia para la jurisprudencia española en cuestiones de reconocimiento de laudos arbitrales extranjeros.International arbitration is an institution that has undergone a significant evolution in recent years. Law 60/2003, inspired by the UNCITRAL Model Law, regulates arbitration in a unitary manner and aims to solve such problems by betting on flexible criteria to determine the validity of the arbitration agreement, advocating the prudence of the arbitrator or arbitrators, limiting the application of law elected by the parties to public order and minimizing judicial intervention in the arbitration procedure. In addition, the Spanish legal system has two international reference arbitration instruments: the New York Convention of 1958 and the Geneva Convention of 1961. Both have been and continue to be reference arbitration instruments for Spanish jurisprudence in matters of recognition of awards foreign arbitration.
